1. Agreement & Scope

Scratch Upload is a private, community-first image hosting service. By accessing the site, creating an account, or uploading any content, you affirm that you have read, understand, and agree to these Terms of Service and all referenced policies. If you cannot agree, you must not use the service.

2. Data Protection & Privacy

We prioritize the privacy of all users. All processing of personal information follows our Privacy Policy, which explains what data we collect and why. We keep data only as long as needed to provide the service or meet legal obligations.

• Only essential cookies and telemetry are used.
• Security logs (including IP addresses) are retained for abuse prevention and legal compliance.
• We do not sell or share user data with advertisers or data brokers.

3. Service Availability & Backups

You are responsible for all activity under your account. Do not share your credentials. If you believe your account is compromised, you must notify us immediately.

4. Content Standards

Strictly Prohibited Content

• Sexual or fetish content: Pornography, explicit nudity, fetish material, sexualized depictions of minors (real or fictional), or anything intended to arouse.
• Artistic or educational content: Nudity or mature themes in art, educational materials, or historical documentation are allowed if they do not violate other content standards and are not primarily intended to be sexual in nature.
• Exploitation or abuse: Doxxing, harassment, threats, stalking, grooming, or any material that facilitates exploitation of vulnerable individuals.
• Graphic violence or self-harm: Gore, mutilation, instructions or encouragement for self-harm or suicide.
• Hate or extremist content: Anything promoting hatred, discrimination, or violence against protected classes or marginalized communities.
• Illegal activity: Depictions that facilitate or document crimes, including CSAM, revenge porn or trafficking.
• Malware and security abuse: Viruses, exploits, phishing kits, credential harvesting, or attempts to circumvent the whitelist, API limits, or S3 protections.

Please note, that we do not scan or moderate content proactively (aside from Malware and CSAM). If you see something that violates these terms, please report it to us immediately, we only scan for malware and CSAM.

5. Enforcement & Reporting

• We may remove content, suspend uploads, restrict access, or terminate accounts without prior notice for any violation or suspected violation.
• Serious offenses, especially involving minors or imminent harm, will be reported to the appropriate authorities and relevant platforms.
• Email admin@8ball.space to report violations. Provide as much detail as possible so we can respond quickly and discreetly. All reports remain confidential unless required by law.

6. Ownership & License

These terms are governed by applicable law in our jurisdiction. Any disputes must be resolved under that law.

7. Limitation of Liability

To the fullest extent permitted by law, Scratch Upload, its maintainers, and volunteers are not liable for data loss, service interruptions, unauthorized access, content violations, or any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the service or inability to use the service. This includes any damages resulting from reliance on content, actions of other users, or interactions with third-party services. We provide the service "as is" without warranties of any kind, either express or implied. By using the service, you agree to indemnify and hold harmless Scratch Upload and its maintainers from any claims arising out of your use of the service or violation of these terms.

8. Compliance With Law

These terms are governed by the laws applicable to the service operator. Disputes must be resolved under that jurisdiction.
